As my final blog for 2014, I want to summarize what I believe to be my most successful endeavor in social justice for this year. It is the case in Montana that in social media became known by the hashtag #Justice4Cherise.

In 2013 and 2014, I worked closely with both Montana NOW and Pennsylvania NOW to remove G. Todd Baugh—a local Montana judge—from the bench in Yellowstone County, MT for using rape myths to trivialize the 2007 rape of a 14-year-old girl Cherise Moralez by her high school teacher Stacey Rambold. The trivialization of this crime committed against this young woman occurred after she had died in 2010 by suicide and could no longer speak for herself.

Baugh sentenced Stacey Rambold to 30 days in jail because the girl was “as much in control of the situation” as her rapist and that she looked “older than her chronological age.”

Using my blog site and the Pennsylvania NOW Education Fund website as a public forum and pinning my blog posts to Pinterest, Facebook, Twitter and other social media, I worked with others to spread the word about this case and called upon the state to provide #Justice4Cherise. Here’s the chronology (with links) to what happened from August 2013 through December 2014.

August 2013

We helped spread the word that we were collecting signatures through We Are UltraViolet of our outrage at Judge G. Todd Baugh’s unethical behavior on the bench and called for his removal by the Montana Judicial Standards Commission (August 29, 2013).

September 2013

We then filed a complaint with the Montana Judicial Standards Commission about Baugh’s unethical behavior. We presented the background of the rape case and a summary of Judge G. Todd Baugh’s misconduct; cited the portions of the judicial rules of conduct that were violated; and noted that thousands of “witnesses” had joined Montana and Pennsylvania NOW in this complaint. These witnesses included more than 250,000 people around the world who called for either the resignation or removal of Judge Baugh (September 24, 2013);

December 2013

Baugh Responds to Our Complaint and We Respond Back

We announced that “Judge” Baugh had agreed with our complaint that he had violated one of the three ethical rules we cited in our September complaint. He did say that he failed to

“promote public confidence in the independence, integrity, and impartiality of the judiciary, and [did not] avoid impropriety and the appearance of impropriety [by his actions].”

His response to our complaint then continued with additional bias and use of rape myths to support his unethical behavior. So we responded with a written follow-up to our complaint and again let the public know what was happening (December 8, 2013).

Amicus Brief Filed

Five days later, six women’s groups — Montana NOW, Pennsylvania NOW, Legal Voice, Sexual Violence Law Center, Women’ Law Project, and Legal Momentum — filed an amicus brief before the Montana Supreme Court. This brief documented the rape myths that Baugh used in determining and handing down the sentence he gave to former teacher and convicted rapist Stacey Rambold. We were supporting the Montana Attorney General’s call for overturning the original sentence and remanding the case back to Yellowstone County Court for re-sentencing. The amicus brief we filed focused on rape myths and their inappropriate impact in adjudicating and sentencing in sexual-assault cases. We asked the court to take the effect of these types of rape myths into account when making their decision in this case and, upon remand, to assign the case to a new judge for sentencing. Our amicus went further than the Attorney General’s appeal in that we did not want Baugh to do the resentencing and that we wanted the Supreme Court to order the county to reassign the case to another judge who would be less biased in handling sexual assault cases (December 13, 2013).

January 2014

In January 2014, after reviewing Baugh’s response to the complaints filed against him, the Montana Judicial Standards Commission recommended to the Montana Supreme Court that they publicly censure him for his unethical behavior. Meanwhile the Montana Attorney General’s appeal of the Rambold sentence handed down by Baugh worked their way behind the scenes in the Montana Supreme Court.

What Happened to Rambold

April 2014: Sentence Overturned

On April 30, the first outcome of these two cases was announced (April 30, 2014). With a review of all the legal documents provided to the court (no hearing was held as the Court felt they had enough information from the documentation they received), the Montana Supreme Court handed down their decision in the Montana v. Rambold case. The Court overturned the 30-day sentence and remanded the case back to Yellowstone County ordering a new judge to resentence Rambold using the mandatory sentencing guidelines for rape. The last two paragraphs of the Court’s opinion indicate that the Court heavily relied on our amicus in ordering the remand:

¶21 On remand for resentencing, we further instruct the court to reassign the case to a different judge to impose sentence. We have considered several factors to decide whether a new judge should be assigned to resentence a defendant in a particular case, among them; whether the original judge would reasonably be expected to have substantial difficulty in putting out of his or her mind previously expressed views determined to be erroneous, whether reassignment is advisable to preserve the appearance of justice, and whether reassignment would entail waste and duplication out of proportion to any gain in preserving the appearance of fairness. Coleman v. Risley, 203 Mont. 237, 249, 663 P.2d 1154 (1983) 10 (citations omitted). In State v. Smith, 261 Mont. 419, 445-46, 863 P.2d 1000, 1016-17 (1993), we remanded for resentencing to a new judge when the judge’s statement at trial evidenced bias against the defendant. Even where bias did not require reassignment to a new judge, we have reassigned where media coverage and public outrage “have snowballed to create an appearance of impropriety.” Washington v. Montana Mining Properties, 243 Mont. 509, 516, 795 P.2d 460, 464 (1990).

¶22 In the present case, Judge Baugh’s statements reflected an improper basis for his decision and cast serious doubt on the appearance of justice. The idea that C.M. could have “control” of the situation is directly at odds with the law, which holds that a youth is incapable of consent and, therefore, lacks any control over the situation whatsoever. That statement also disregards the serious power disparity that exists between an adult teacher and his minor pupil. In addition, there is no basis in the law for the court’s distinction between the victim’s “chronological age” and the court’s perception of her maturity. Judge Baugh’s comments have given rise to several complaints before the Judicial Standards Commission, which has recommended disciplinary action by this Court. Those complaints will be addressed in a separate proceeding. Under these circumstances, we conclude that reassignment to a new judge is necessary to preserve the appearance of fairness and justice in this matter.

May 2014: Appeal Filed and Subsequently Denied

On May 14, Rambold’s attorney appealed the Supreme Court’s order to overturn the minimal sentence originally handed down and used the same arguments given by Baugh – “It was her [the victim’s] fault.” He seemed to say that the circumstances surrounding the rape of a minor and her responses to her teacher’s advances isn’t all that bad and therefore no change in the original sentence should be made.

September 2014: Resentencing

The Supreme Court denied the appeal and on September 26, Rambold was resentenced in Yellowstone County District Court.

According to the Billings Gazette, Judge Randall Spaulding sentenced Rambold to 15 years in prison with five years suspended for the rape of Cherise Moralez. The Gazette reported that Judge Spaulding said that

the victim’s age, Rambold’s position as a teacher and Rambold’s response to being warned by school officials all factored into [the] sentencing. [And] Rambold’s Internet usage was an aggravating factor [in determining the length of the sentence].”

On November 24, Rambold’s attorney Jay Lansing filed a “notice of appeal” to the Montana Supreme Court for the 10-year sentence; so far, the reasoning behind this appeal is unknown. We will continue monitoring what is happening in the months to come to see what happens.

What Happened to Baugh

June 2014: Supreme Court Decision

Meanwhile, back to G. Todd Baugh. As the April 30 decision by the Montana Supreme Court hinted at in the Rambold case, censure was in the air for G. Todd Baugh. On June 4, the Court announced that they would not only be censuring Baugh in public for his unethical behavior but that he would also be suspended from the bench. Here’s a link to that decision. We believe and agree with the Court’s written opinion that “There is no place in the Montana judiciary for perpetuating the stereotype that women and girls are responsible for sexual crimes committed against them.”

July 2014: Public Censure

Baugh was given time to respond to this decision of censure and suspension. And on July 22, the public censure was handed down. Marian Bradley, former President of Montana NOW, and I were in the courtroom for the public censure. Baugh stood before the Court for the censure, but said nothing.

According to the Billings Gazette, Chief Justice McGrath “did not read a sentence in the transcript of the censure that asked if Baugh had anything he wanted to say.” We had a statement ready to read to the court. Unfortunately, we were not allowed to speak about our concerns before the Court, most likely because the Court did not want to hear any more of Baugh’s excuses for his behavior. We had expected to deliver these comments publicly. Since we were unable to speak them, we sent our statement directly to Baugh and posted them on this blog for the world to see (July 22, 2014).

This blog was followed up on the Pennsylvania NOW Education Fund website with a more detailed overview of rape myths that Baugh and other members of the judiciary have used in trivializing rape (August 31, 2014).

December 2014: Suspension

On December 1, Baugh was suspended from the bench without pay. Today (January 31) is the last day of his suspension. Since he decided not to run for reelection for the bench, he will not be returning to work as a judge as he no longer has a seat within the judiciary. He is gone.

Pennsylvania for Women’s Health Agenda Update

Last September, a bicameral, bipartisan caucus was created in the Pennsylvania General Assembly to review, discuss, and propose legislation to improve the health of women in the Commonwealth by addressing the genuine needs and concerns of women in the state. The Pennsylvania Agenda for Women’s Health was created as a comprehensive plan to address the real-life stories and concerns of women in terms of protecting and expanding women’s reproductive health, improving women’s economic security, and improving safety in their lives.

The First Set of Bills

On December 11, the first five bills were presented and introduced into both the House of Representatives and the Senate. The first set of bills addressed a variety of concerns for women by:

  • Making sure that women receive pregnancy accommodations in their workplace;
  • Creating a 15-foot buffer zone around entrances to health to make sure women seeking reproductive healthcare are able to access it in an orderly and safe manner;
  • Addressing “pay secrecy” and the “factor other than sex” loophole will help to end practices that have enabled employers to pay women less than men for the same work;
  • Expanding access to cervical cancer treatment. This bill is a state Pay Equity bill similar to the federal Paycheck Fairness Act;
  • Eliminating local ordinances that penalize landlords and/or tenants who call the police or emergency services “too frequently;” and
  • Outlawing “revenge porn,” a form of digital intimate-partner violence.

Of the first six set of bills, four have had some movement since my first detailed look at the bills on January 22.

Pregnant Workers’ Fairness Act

The House version of the Pennsylvania Pregnant Workers’ Fairness Act (HB 1892) was formally introduced and referred to the House Labor and Industry Committee where it is still awaiting a hearing. The companion Senate bill (SB 1209) was introduced on March 31 and was referred to the Senate Labor and Industry Committee; it too is awaiting its first hearing.

Pay Equity

The Pay Equity Bill basically hasn’t moved since being introduced. The House version (HB 1890) was introduced and referred to House Labor and Industry Committee on February 19. The Senate version (SB 1209) was introduced and referred to Senate Labor and Industry Committee on March 31; it has not moved since its introduction. However, the House sponsors of HB 1890 have filed a “Resolution to discharge committee from further consideration.” This was filed on April 7. This type of resolution is a rarely used tactic to force debate on a bill when the chair of the committee the bill is assigned to refuses to hold hearings on the bill. We are now waiting to see how the full House will respond to this resolution.

Victims of Crime

The bill protecting victims of crime by eliminating local ordinances that penalize landlords and/or tenants who call the police or emergency services “too frequently” (HB 1796) was introduced on October 22. After its introduction, the House Local Government Committee amended the bill to clarify that bill only applies to cases that involve victims of violence, abuse, or “individuals in an emergency” if the person making the call had a reasonable belief that police intervention or emergency assistance was needed. It unanimously passed House January 14, 2014. It was then referred to Senate Local Government Committee. January 21, 2014. Unfortunately, on March 11 the Senate Local Government Committee was tacked on an ALEC bill as an amendment, turning this good bill into a bad bill. This local ordinance sick-leave preemption bill undermines the safety of domestic violence victims. Under the amendment, local governments would lose their authority to require employers to offer paid or unpaid leave to victims of domestic violence and sexual assault. Leave from employment is often critical to a victim’s survival in both the short- and long-term. This amendment adds another purpose and intent to HB 1796 that conflicts with its original commitment to protect victims. Advocates, including but not limited to the Pennsylvania Coalition Against Domestic Violence, the Women’s Law Project, and Pennsylvania NOW, are urging the legislature to support the version of HB 1796 that was passed by the House of Representatives and to remove the problematic language that was adopted in Senate Local Government Committee. We still support the portion of HB 1796 that would eliminate local nuisance ordinances that penalize a victim for seeking help from emergency services. As a result of our subsequent lobbying to remove this amendment, the Senate has temporarily tabled the bill.

Revenge Porn Prohibition

The “Revenge Porn” bill is the most successful of this first round of bills. The Senate version (SB 1167) was amended in Senate Judiciary Committee January 14, 2014 and sent to the floor for 1st consideration. It unanimously passed the Senate on January 28, 2014 and is now residing in the House Judiciary Committee alongside HB 1901.

The Second Set of Bills

Today, the Women’s Health Agenda Caucus announced the second package of bills to be introduced. They include five bills intended to:

  • Curb political interference in providers’ medical decisions. This bill protects the doctor-patient relationship from directives to practice care in a manner that is not in accordance with standards of care;
  • Identify gaps in health care for women veterans by establishing the Task Force on Women Veterans’ Health Care to study health issues facing women veterans;
  • Fight deep poverty among women with children. This bill Includes a study of family work support programs in the Commonwealth, increases the monthly Temporary Assistance to Needy Families (TANF) benefits for women in need; and increases in the TANF Earned Income Disregard;
  • Ensure that widows of state and municipal employees get fair pensions by requiring public employees to obtain spousal consent for benefit payment structures that do not provide at least a 50% survivor benefit; and
  • Protect all employees against sexual harassment by extending the prohibition on sexual harassment to all employers in the state.

Pennsylvania NOW is one of the organizations supporting this full agenda to improve women’s health. I am their lobbyist. At the press conference this morning, I handed out our statement of support. In that statement, I supported each of these bills, saying, “It’s high time that doctors were supported in their right to refuse to provide medically inaccurate information. The increases to TANF cash assistance grant levels and the eligibility asset limit will encourage saving and financial independence. We’re also glad to see sexual harassment protections extended to all workers, and see that female veteran’s health concerns finally get the attention it deserves.”

As advocates for women’s health and equity we are pleased to see the legislature taking a pro-active stance to help improve the lives of women here in Pennsylvania. As Caryn Hunt said in the Pennsylvania NOW press release, ““The women of Pennsylvania need – and now finally have – champions in the legislature who recognize that government must work for all of the people, women included.” We are pleased and “strongly support this Agenda that puts the health and well-being of women and their families first.”

Seeking Justice for Cherise

In August 2013, Yellowstone County (Billings), Montana Judge G. Todd Baugh sentenced ex-teacher Stacey Rambold to thirty days in jail for raping one of his 14-year-old students . Baugh had followed a recommendation from Rambold’s lawyer by giving Rambold a sentence of 15 years in prison with all but 31 days suspended and a one day credit for time served. Even worse, the judge showed gender and racial bias against Cherise Morales—the 14 year old, Hispanic girl who Rambold raped. During the sentencing hearing, Baugh stated that  the girl was “as much in control of the situation” as her rapist and that she was “older than her chronological age.”

Upon hearing about this incident, Joanne Tosti-Vasey, former PA NOW president and current member of the PA NOW Executive Committee contacted Montana NOW President Marian Bradley. After consulting with each other, Montana NOW and Pennsylvania NOW decided to coordinate a state and national action to push back against this egregious behavior and use of rape myths.

We focused on both the unethical behavior of Judge Baugh and on working to overturn the illegal sentence handed down on Rambold.

The Ethics Complaint Against Judge Baugh

First, we focused on a petition to sanction Judge Baugh. The first step was to help get a groundswell of people calling for the Montana Judicial Standards Commission to review and sanction Judge Baugh for his behavior. Working with We are Ultraviolet and Fitzgibbon Media we gathered over 130,000 signatures calling for the state to sanction Judge Baugh. Meanwhile we contacted Legal Momentum (a national women’s advocacy organization that houses the National Judicial Education Program on Gender Bias in the Courts) and Pennsylvania’s Women’s Law Project to assist us in crafting our complaint.

Using these petition signatures, we publicly delivered our complaint on September 24, 2013 against Baugh urging the Montana Judicial Standards Commission and the Montana Supreme Court to

  • Remove Judge Baugh from the bench for his misconduct related to his handling of and speech about the rape case involving the sentencing of Stacey Rambold; and
  • Implement a mandatory judicial education program for the judiciary on the fair adjudication of sexual assault cases to help the Montana justice system develop techniques to minimize victim re-traumatization while safeguarding the rights of the defendant.

As a result of this complaint and several others, Judge Baugh acknowledged on December 7, 2013 that he violated one of the three ethics rules we alleged he had violated. He said that he had failed to “promote public confidence in the independence, integrity,and impartiality of the judiciary,” and did not “avoid impropriety and the appearance of impropriety.” But he refused to acknowledge that  he used racial and gender bias in handing down the sentence and as a result, did not uphold the law. So we submitted a response detailing the rape myths he used in creating the sentence and in not following the law with the minimum, mandatory two-year sentence.

Then Baugh, in an effort to avoid the sanctions he could see coming, announced in January that he would not be seeking reelection in 2014. A couple of weeks after this announcement, the Montana Judicial Standards Commission announced that they were sending a recommendation to the Montana Supreme Court to use their oversight powers to sanction Judge Baugh.

The Amicus Brief

Meanwhile, on December 6, 2013, the Montana Attorney General’s office filed an appeal before the Montana Supreme Court. They are asking the court to remand the case back to the Yellowstone County District Court for sentencing that would follow the state law’s mandatory minimum sentencing guidelines.  They are asking for, at minimum, a four-year sentence.

NOW once again weighed in. Knowing that it is possible for advocacy groups to file “friend of the court” amicus curiae briefs, we contacted two members of our network of women’s legal advocacy organizations—The Women’s Law Project and Legal Momentum—to see if there was any interest in pursuing this amicus.  They put us in contact with Legal Voice and the Sexual Violence Law Center. Both of these organizations are based in Seattle, Washington and serve women in Montana.  As a result, all six organizations agreed to file an amicus.Attorney Vanessa Soriano Power and other members of the law firm Stoel Rives LLP took the lead in writing our brief and petitioning the Court to add our brief to their review of this case.

The amicus brief we filed focuses on rape myths and their inappropriate impact in adjudicating and sentencing in sexual-assault cases.  We are asking the court to take the effect of these types of myths into account when making their decision in this case and, upon remand, to assign the case of Stacey Rambold to a new judge for appropriate and legal re-sentencing.

What’s Happening Now?

Both cases were sent to the Montana Supreme Court for review. We heard on April 25 (the 10th anniversary of the March for Women’s Lives in Washington DC that brought out over one million people) that the decisions on what type of sanctioning Judge Baugh will receive and whether or not Stacey Rambold will be re-sentenced is pending.

This morning, the Montana Supreme Court handed down their decision in the Montana v. Rambold case (copy of the opinion can be seen here). The Court listened to the arguments presented by both the Attorney General’s office and by NOW. They overturned (“vacated”) the 30-day sentence and remanded the case back to the Yellowstone County Courts for re-sentencing in line with the minimum mandatory sentencing guidelines. In addition, they have ordered the county to assign the case to another judge for Rambold’s re-sentencing.

The last two paragraphs of the opinion indicate that the Court heavily relied on our amicus in ordering the remand:

¶21 On remand for resentencing, we further instruct the court to reassign the case to a different judge to impose sentence. Those complaints will be addressed in a separate proceeding.

We feel strongly that our work on this case shows our commitment to looking out for the women, children and families of our states and our nation. This behavior by our teachers and our judiciary should not and will not be tolerated. Our vigilance will continue.

In August 2013, Judge G. Todd Baugh issued a 30-day jail term for one guilty plea by Stacey Rambold for one count of sexual intercourse without consent against a 14-year old minor.  NOW, UltraViolet, and people around the world expressed outrage at this judge’s use of rape myths to minimize the assault and create a sentence that was way below the mandatory minimum for such an offense. Following the initial outrage, Montana NOW and Pennsylvania NOW filed a joint complaint with the Montana Judicial Standards Commission about Judge Baugh’s violation of the state’s judicial Rules of Conduct.  Then last weekend, Montana NOW and Pennsylvania NOW responded to Judge Baugh’s refusal to acknowledge bias and prejudice in his sentencing of Rambold.

Meanwhile the Montana Attorney General’s Office (AG) filed an appeal with the Montana Supreme Court on December 6 to remand the case back to the Yellowstone County District Court for sentencing that would follow the state law’s mandatory minimum sentencing guidelines.  They are asking for minimally at least a four-year sentence.

After finding out about the AG’s intent to appeal the original jail term, Montana NOW and Pennsylvania NOW looked into the possibility of filing an amicus brief to the court to support the appeal.  We contacted two members of our network of women’s legal advocacy organizations—The Women’s Law Project and Legal Momentum—to see if there was any interest in pursuing this amicus.  They were interested and helped put us in contact with Legal Voice and the Sexual Violence Law Center. Both of these organizations are based in Seattle, Washington and serve women in Montana.  As a result, all five organizations agreed to take on this amicus; Attorney Vanessa Soriano Power and other members of the law firm Stoel Rives LLP took the lead in writing our brief.   Thank you all for assisting and working with us on this brief.  We couldn’t have done it without your legal expertise and caring about this miscarriage of justice.

The amicus brief we filed focuses on rape myths and their inappropriate impact in adjudicating and sentencing in sexual-assault cases.  We are asking the court to take the effect of these types of myths into account when making their decision in this case and, upon remand, to assign the case to a new judge for sentencing.

We state in this brief that rape myths are a form of gender bias that destroys the integrity of the judicial process and contravenes Montana law. The three myths we focus on are:

  1. Blaming the Victim
  2. The Myth of the Nonviolent Rapist and Implied Consent
  3. The Lolita Effect and Power Dynamics in Sexual Assaults

After presenting the background on these myths, we then link them to what we believe happened in this case based on the statements made by Judge Baugh and his minimal sentencing of Rambold.  We show that the District Court’s erroneous reliance on these rape myths pose a threat to sexual assault survivors’ confidence in  the judicial system. We then request that the Supreme Court use their supervisory authority to not only remand the case back to the District Court, but also to assign a new judge for the new sentencing.

On December 11, the Pennsylvania General Assembly’s Health Agenda Caucuses rolled out the first set of bills that are part of the Pennsylvania Women’s Health Agenda.  The Agenda was spearheaded by Representative Dan Frankel (D-Allegheny), Senator Judy Schwank (D-Berks) and Senator Chuck McIlhinney (R-Bucks and Montgomery). These legislators were assisted by several of their colleagues, including  Representatives Mary Jo Daley (D-Montgomery), Tina Davis (D-Bucks), Maria Donatucci (D-Delaware and Philadelphia), Erin Molchany (D-Allegheny), Mark Painter (D-Montgomery), and Brian Sims (D-Philadelphia) made the announcement of the roll-out. They announced that this first set of bills would soon be going to committee.

To Improve Women’s Health

Harrisburg, PA – The Women’s Law Project and its civic engagement action arm, WomenVote PA, commend the Women’s Health Caucus, a bipartisan, bicameral caucus of the Pennsylvania General Assembly, as it unveils the first phase of a comprehensive Pennsylvania Agenda for Women’s Health. Led by Representative Dan Frankel and Senators Judy Schwank and Chuck McIlhinney, the Caucus is taking a proactive, positive approach to helping women by addressing a wide range of legal and policy barriers to women’s health and equality.

Each component of the Pennsylvania Agenda for Women’s Health arises out of the struggles of real women in Pennsylvania. Pennsylvania NOW Supports the Pennsylvania Agenda for Women’s Health

HARRISBURG, December 11, 2013—The Pennsylvania state chapter of the National Organization for Women (PA NOW) applauds the work of the House and Senate Women’s Health Caucuses as they roll out a comprehensive plan to address the real issues affecting Pennsylvania women today. Spearheaded by Representative Dan Frankel, Senator Judy Schwank and Senator Chuck McIlhinney in conjunction with the Women’s Law Project, and then developed by a broad coalition of Pennsylvania advocacy organizations that work on behalf of women every day, it is based on years of experience about what women want and need to stay healthy. This Agenda goes a long way to redressing entrenched inequities for women in Pennsylvania.

“Pennsylvania Republicans, like their counterparts in other state legislatures, have obsessed about women’s reproductive rights and have waged a non-stop campaign to control them from the capital, rolling back not just access to safe, legal abortion, but also the sense that women are full citizens entitled to a government and society that also works for them,” said Pennsylvania NOW President-Elect Caryn Hunt. “This agenda provides an antidote to the shallow, rhetorical policy-making of those in the General Assembly who have led the calls for women’s restrictions and called it concern for women’s health. It’s refreshing to see so many bills introduced that will genuinely help women, and that together provide a much truer portrait of the needs women want their representatives to address.”

These first bills address a variety of concerns for women: pregnancy accommodation is a common sense step to ensure that pregnant women are treated not as liabilities, but as persons with a temporary need for reasonable accommodations in the workplace; the bill to provide at 15-foot buffer zone around entrances to health clinics is a necessity in our state to make sure women seeking reproductive healthcare are able to access it in an orderly and safe manner; bills targeting “pay secrecy” and the “factor other than sex” loophole will help to end practices that for too long have enabled employers to pay women less than men for the same work. Other bills fill gaps in existing protections for nursing mothers, victims of intimate partner harassment and of domestic violence.

“The ideas for change in this package of bills come from real-life stories of women,” added Joanne Tosti-Vasey, President Emerita and Lobbyist for Pennsylvania NOW. “They include calls to service agencies, cries for help on hot lines, requests for advocacy, and lots of research to back up the anecdotal stories. As advocates, we realize there are other areas of concern, but believe the Women’s Health Caucuses’ agenda items are a great start.”

Pennsylvania NOW has high hopes for the Women’s Health Agenda. Finally, the concerns and needs of Pennsylvania are being honestly addressed by their representatives, rather than attacked and abridged.

Pennsylvania’s Proposed Women’s Health Agenda

Yesterday (Monday, September 30, 2013), I attended a two-hour meeting with Pennsylvania’s House and Senate members of the joint Women’s Health Agenda Caucus led by Representative Dan Frankel of Pittsburgh. Some of the advocacy groups attending the meeting included the Women’s Law Project (WLP), Women Vote PA, and members of the Pennsylvanians for Choice coalition including Pennsylvania NOW whom I represented.

For a very long time Pennsylvania has focused on restricting women’s access to abortion services – currently accounting for over 1270 pages of legislation and regulations in the state.  This wrong-headed approach to health assumes that women’s sole need is to protect them from safe, legal access to decent abortion care services.  In other words, the state has wrong-headedly been crafting laws and regulations to deny access to abortion, sending more and more women to the back alleys similar to the Gosnell clinic and ignoring the broader issues of women’s health equity.

Women’s concerns about their health are broadly based in bias based on gender. Terry L. Fromson, Amal Bass, Carol E. Tracy, Susan Frietsche of the Women’s Law Project  created a report entitled Through the Lens of Equality: Eliminating Sex Bias to Improve the Health of Pennsylvania’s Women in 2012.  The WLP is Pennsylvania’s feminist legal organization that engages in litigation, advocacy, and education to ensure women’s equality and treatment in Pennsylvania. This report set the context for yesterday’s meeting.  The WLP framed the health care agenda as follows in this report and in the meeting this morning:

The legal and social status of American women has changed dramatically in the last fifty years. Half a century ago, it was legal to segregate jobs by sex, to refuse to hire or promote on the basis of a person’s sex, to fire women who became pregnant, and to limit the number of women admitted to professional schools such as law and medicine. Sexual and domestic violence were hidden from public view and public policy. Abortion was illegal and the birth control pill was not yet on the market. Today, women have taken their place in the working world and educational opportunities for women have expanded exponentially. Sexual and domestic violence are recognized as crimes and some resources are available to its victims. Abortion is legal and birth control is available.

Despite these advances, deeply embedded cultural biases and stereotypes about women’s place in society continue to impede women’s equal participation in society. In our homes and communities women are subjected to violence, poverty, and the burden of care taking responsibilities. In the workplace, women are paid less than men for the same work, remain concentrated in stereotypically female low-paying occupations, are subjected to sexual harassment and discrimination on the basis of pregnancy and care giving, and are denied advancement to managerial and higher paying positions. In school, young women are denied their fair share of sports opportunities and are sexually harassed and violated. Women are denied essential reproductive health care and subjected to discrimination in access to insurance coverage. Women pay more than men for the same coverage, and pregnancy is a preexisting condition that often denies pregnant women access to insurance coverage and therefore maternity care.  Access to abortion has been limited by burdensome legislative requirements, and providers and patients have been terrorized by an increasingly violent opposition. Attacks on access to contraceptive services have grown.

While many laws have been adopted to eliminate sex discrimination at work and at school, gaps persist that must be filled and enforcement needs to be strengthened. This is particularly true in Pennsylvania. While some Pennsylvania cities have outlawed employment discrimination on the basis of care-giving responsibilities and provide other accommodations for women who work, the Pennsylvania legislature has failed to adopt a statewide prohibition on discrimination on the basis of caregiver status or to provide family leave for caregivers. In Pennsylvania, the law permits insurers to price the cost of health insurance higher for women than for men, resulting in women paying more for individual health insurance policies and small employers paying more for health insurance for a predominantly female workforce. Pennsylvania’s sexual assault laws have for the most part eliminated discriminatory provisions, but the myths and stereotypes that continue to infect the criminal justice system hinder the investigation and prosecution of these crimes. The health care perspective on domestic violence and sexual assault is far too limited. Sexual assault is treated as a health care matter primarily in the immediate aftermath of a rape, even though the physical and emotional health consequences can be long lasting. Although a number of health care providers recognize that domestic violence is also a health issue, screening for domestic violence in health care settings is not universal. Poverty, which disproportionately impacts women, exacerbates the impact of sex bias in all of these realms….

Pennsylvania, with 6.5 million women, has consistently been found deficient in national studies on women’s health care measures. In their 2010 health report card, the National Women’s Law Center and Oregon Health & Science University placed Pennsylvania 32 among the 50 states and graded it unsatisfactory with respect to the status of women’s health….

To alleviate women’s health problems, it is necessary to eliminate adverse experiences — discrimination and bias — early in life and throughout life — and to improve access to health care, with an emphasis on care essential to women (pp. x-xii).

Representative Frankel heard this call to refocus the legislature from attacking women’s reproductive health to focusing — just like New York state’s “10 Point Plan for Women’s Equality” — on redirecting legislation in the General Assembly towards a women’s health equity agenda. So yesterday, almost 20 legislators from both houses attended a meeting with advocates seeking to improve women’s lives and health through a broad review and revision of Pennsylvania law.  The agenda covers reproductive health, women’s economic security, and women’s safety.

The ideas for change come from real-life stories of women in the state.  Calls to service agencies. Cries for help on hot lines. Requests for advocacy. And of course lots of research to back up the anecdotal stories.  The 24 suggested changes to Pennsylvania law that were presented are in areas where either no legislation has been introduced or where legislation to improve the bias are lagging or need to be revisited.  We, as advocates, understand that there are other areas of concern, but believe these health care agenda items are a good start.

Some of these ideas are conceptual at this point. Some have some preliminary model wording for new legislation, and some are already in the works.  Here’s the agenda:

Protect and Expand Women’s Reproductive Health Rights

  1. Pregnancy Accommodations:  Require employers to provide accommodations to pregnant employees with temporary pregnancy-related conditions to allow workers to remain employed throughout their pregnancies while imposing minimal burdens on employers.
  2. Support for Breastfeeding Mothers in the Workplace: Require all employers to provide compensated break time and a private, sanitary (not a bathroom) for all employees who need to express milk.
  3. Buffer Zones:  Enact a statewide reproductive health care clinic buffer zone statute to protect safe access to essential health care.
  4. Inmate Shackling: Strengthen pregnant inmate shackling law (Act 45 of 2010) to cover the entire pregnancy and a reasonable post-partum period for mother-child bonding and to eliminate the tasering of any woman known to be pregnant.
  5. Medical Professional Conscientious Right to Refuse to Deliver Medically Inaccurate Information: Protect physician-patient relationships from political intrusion.

    Improve Women’s Economic Security

  6. TANF (Temporary Assistance to Needy Families) Grant Amount: Increase TANF cash assistance grant levels.
  7. TANF Asset Limit: Increase the TANF eligibility asset limit to encourage saving and financial independence.
  8. Earned Income Disregard: Increase the earned income disregard and apply it to applicants as well as recipients.  FYI, the earned income disregard allows very-low income workers to continue receiving TANF, food stamps, and Medicaid if they make 50% or less of the poverty level.  This proposed legislation would raise this “disregard” level to 75% and would apply to applicants as well as recipients.
  9. Childcare Works Waiting List: Eliminate the childcare works waiting list.
  10. TANF Pre-Application Job Search: Eliminate or modify the TANF pre-application job search requirements.
  11. Minimum Wage: Increase Pennsylvania’s minimum wage from $7.25 to $9.00/hour.
  12. Gender Wage Gap: Strengthen Pennsylvania law to eliminate the 24% gender wage gap by prohibiting retaliation against employees for discussing wages (“pay secrecy”) and closing the “factor other than sex” defense to apply only to bona fide business-related factors.
  13. Family Responsibilities Employment Discrimination: Prohibit family responsibilities discrimination in employment by amending the Pennsylvania Human Relations Act to prohibit family status discrimination in employment pursuant to an expanded definition of familial status to encompass the true scope of familial responsibilities shouldered by employees.
  14. Paid Family and Sick Leave: Require all employers to provide employees with paid family and sick leave
  15. Spousal Pension Benefits: Require spousal consent when a retiring state employee chooses how his or her pension benefits should be paid consistent with federal law protecting each spouse from his or her spouse’s selection of a pension benefit in all privately-sponsored pension plans and laws adopted by other states.
  16. Domestic Worker Protection: Amend Pennsylvania anti-discrimination laws to provide domestic workers protection from employment discrimination
  17. Sexual Harassment: Extend the prohibition on sexual harassment in employment to all employers, even small employers.

    Protect Women’s Personal Safety

  18. Paid Leave for Domestic Violence, Sexual Violence, and Stalking Victims: Require employers to provide paid leave to obtain assistance for and pursue legal protection against domestic and sexual violence and stalking.
  19. Housing Discrimination: Prohibit private and public housing discrimination against domestic violence victims.
  20. Civil Orders of Protection for Sexual Violence and Stalking Victims: Authorize courts to issue civil orders of protection for sex crime and stalking victims.
  21. Absolute Privilege for Student Victims: Protect victims/witnesses of sexual assault who testify in school grievance proceedings from being sued by their harassers.
  22. Human Trafficking: Strengthen Pennsylvania’s criminal statute on human trafficking.
  23. Veterans’ Real Estate Tax Exemption: Amend Pennsylvania law to provide veterans real estate tax exemption for veterans suffering from PTSD (Post-Traumatic Stress Disorder) due to sexual victimization during service and appoint women representatives to the House and Senate Committees on Veteran Affairs and to the Pennsylvania State Veterans Commission.
  24. Voting Reform: Reform voting rules to provide online registration, same day in person registration, early voting, including early in person voting on weekends.

These ideas will be discussed in continuing meetings between members of the General Assembly’s Health Care Agenda Caucus and advocates for women’s equality.  I’ll post more on these issues as this legislative program becomes better defined.

Montana and Pennsylvania NOW File Judicial Conduct Complaint Against Judge G. Todd Baugh

Today (September 24) at noon MDT, Marian Bradley, President of Montana NOW delivered a complaint to the Montana Judicial Standards Commission calling for the removal of Judge G. Todd Baugh and requesting that the Montana Court System require mandatory sexual-assault training of all judicial employees.

This complaint was created over the last 3 weeks or so by Montana NOW and Pennsylvania NOW, with the assistance of the Women’s Law Project and Legal Momentum.  Marian Bradley, President of MT NOW and I, in my capacity as a member of the Executive Committee of PA NOW worked very closely with Lynn Hecht Schafran, Director of Legal Momentum’s National Judicial Education Program and Carol Tracy, Executive Director; Susan Frietsche, Senior Attorney; and Terry Fromson, Managing Attorney at the Women’s Law Project.  These four women assisted us in crafting the legal wording for this complaint.  We thank them their knowledge and assistance.

The complaint focuses on Judge G. Todd Baugh’s judicial mishandling of a highly publicized rape case, his statements blaming the victim, and his failure to follow state law in sentencing Stacey Rambold who plead guilty to one count of sexual intercourse without consent of a 14-year old Hispanic girl who later died from suicide.

In the complaint, we present the background of the case, a summary of Judge G. Todd Baugh’s misconduct, cite the portions of the judicial rules of conduct that were violated, and cite thousands of witnesses.  These witnesses include more than 250,000 people around the world who are calling for either a resignation or removal of Judge Baugh (see here, here, here, and here for the wordings of the four on-line petitions), media reports from two prominent journalists (here and here), and 350 sexual assault survivors who signed a letter calling for the removal of Judge Baugh.  The complaint was delivered to the Commission with copies of the signatures of the petition signers, the letter from the sexual assault survivors, and links to the two news articles condemning Judge Baugh’s actions.

Note that under Montana state law, once a complaint is filed, all proceedings remain confidential unless the matter is referred to the Montana Supreme Court for potential judicial disciplinary action.  So unless the state’s Supreme Court becomes involved, the public will not know the results of our complaint.  But meanwhile you can see what we are demanding.

And a last-minute addition. On Monday afternoon, September 23, Marian Bradley talked to the Montana Attorney General’s office (Tim Fox-R is the AG). She asked about the possibility of NOW filing an amicus brief to the Montana Supreme Court in relation to the Attorney General’s appeal of Judge Baugh’s sentence in the Rambold case. They informed her that anyone is free to seek permission to file such a brief and then directed her to the office of the Clerk of the Montana Supreme Court for more information on that process.

IRS Ruling a Victory for Married Same-Sex Couples Across the Country!

Thanks to the U.S. Department of the Treasury and the Internal Revenue Service for doing the right thing on August 29. Those of us who live in states, like Pennsylvania, that have their own version of the Defense of Marriage Act (or a constitutional ban in other states on same-sex marriage) will now, at last, have the full federal economic benefits and protections of marriage as long as you were married somewhere that recognizes your marriage. Meanwhile cases challenging state DOMA’s and constitutional bans in federal court on gay marriage need to go forward. The PA ACLU is leading such a case here in Pennsylvania; this groundswell of support for equality WILL succeed. And like in the Loving v. Virginia case, we will eventually have Freedom to Marry for all consenting adults regardless of sexual orientation.

The Internal Revenue Service and the Treasury Department announced yesterday that the federal government will recognize the marriages of legally married same-sex couples for all federal tax purposes, regardless of where those couples reside.

This landmark ruling comes on the heels of the United States Supreme Court’s decision in U.S. v. Windsor in which the Court overturned a key provision (Section 3) of the Defense of Marriage Act.  Section 3 defined the terms “marriage” and “spouse” for purposes of federal law as pertaining only to legal unions between one man and one woman.  Yesterday’s announcement clarifies that when it comes to evaluating the federal tax status of same-sex married couples, it is the “place of celebration” – where the wedding took place – that controls, not the state where the couple resides.  Thus, same-sex couples that marry in one of the states where same-sex…

Third Circuit Upholds Girls’ Free Speech Rights in School

In September 2011, just before I stepped down as Pennsylvania NOW President, PA NOW along with the Feminist Majority, Legal Momentum, and several other feminist organizations signed onto an amicus brief written by the Women’s Law Project in support of two middle school girls from the Easton Area (PA) School District who participated in a youth breast cancer awareness program by wearing “I ♥ boobies” breast cancer awareness bracelets to school.

Kayla Martinez and Brianna Hawk, then seventh and eighth graders, were suspended for wearing Keep A Breast bracelets on Breast Cancer Awareness Day.  Subsequently the school district instituted a district wide ban on the bracelets because they were supposedly “lewd” statements about women’s bodies.  These young women, citing 1st Amendment rights, refused to take them off and then filed suit through their parents after the district-wide ban was instituted.

On August 5, 2013, the 14-member 3rd Circuit Court of Appeals, in a 9-5 en banc decision, upheld the District Court injunction against this ban on educational free speech.  They looked at the question of whether or not speech about women’s bodies and their health could [be] interpret[ed] as lewd, vulgar, profane, or offensive [when that] speech could also plausibly be interpreted as commenting on a political or social issue.”  The court decided that breast cancer is a social issue exception and thus protected speech.  This means that talk about breasts and breast cancer is protected speech in schools throughout Pennsylvania, Delaware, and New Jersey, the three states that fall under the jurisdiction of the 3rd Circuit Court of Appeals.

According to the Keep A Breast Foundation, the makers of this bracelet, the 3rd Circuit Courts decision

“[M]arks the first time a federal court of appeals has ruled that the First Amendment protects student speech that is plausibly understood as commenting on political or social issues.”

The Court’s bottom-line statement in its en banc decision, I believe, says it all:

“The bracelets are intended to be and they can reasonably be viewed as speech designed to raise awareness of breast cancer and to reduce stigma associated with openly discussing breast health.”
